Terms & Conditions

By using Stay the Week, LLC, you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the service. If you use Stay the Week, LLC on behalf of an organization, you confirm you have authority to bind that organization.

Accounts and Access

  • You are responsible for your account credentials and all activity under your account.
  • You must provide accurate account and billing details and keep them current.
  • Homeowners control invitation and property access for their guests.

Billing, Trials, and Renewals

  • Paid plans are billed in advance and renew automatically unless canceled.
  • Free trials convert to paid service unless canceled before trial end.
  • Additional property charges apply based on your selected plan pricing.
  • Fees do not include taxes unless explicitly stated.

Cancellation and Account Deletion

  • You can cancel your subscription from account settings.
  • If you cancel your subscription, you will keep access through the end of your current billing period.
  • Subscription fees are non-refundable, and we do not provide prorated refunds for mid-cycle cancellations.
  • Deleting your account permanently removes account data and cancels your subscription.
  • We may suspend or terminate accounts for misuse, non-payment, or legal requirements.

Acceptable Use

You may not use Stay the Week, LLC to violate laws, attempt unauthorized access, interfere with platform security, distribute malicious software, or abuse other users or support staff.

Data and Privacy

Our handling of personal information is described in our Privacy Policy.

Intellectual Property

The service, including its software, design, and branding, is owned by Stay the Week, LLC and its licensors. These Terms do not transfer ownership rights to you.

Disclaimers and Liability

The service is provided "as is" and "as available" to the maximum extent permitted by law. To the maximum extent permitted by law, Stay the Week, LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Stay the Week, LLC is a software platform only and is not responsible for the accuracy of property listings, property conditions, damages, guest conduct, homeowner conduct, or disputes between users.

Platform Role and User Responsibility

Stay the Week, LLC provides software that allows homeowners and guests to coordinate private property access and bookings. Stay the Week, LLC is not a landlord, broker, real estate agent, property manager, innkeeper, travel provider, or insurer. We do not own, manage, inspect, verify, endorse, or guarantee any property, listing, homeowner, guest, availability, amenity, safety condition, legality, permit status, insurance coverage, or compliance with local rules.

Homeowners are solely responsible for their listings, property conditions, access instructions, guest permissions, taxes, insurance, permits, HOA rules, zoning compliance, occupancy limits, and all obligations related to their property. Guests are solely responsible for their conduct, their use of a property, and their decision to book, access, or stay at a property.

Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Stay the Week, LLC and its owners, officers, affiliates, employees, and service providers from and against claims, losses, liabilities, damages, judgments, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your account, your listings, your property, your invitations, your stays, your misuse of the service, your violation of these Terms, or your violation of any law or the rights of another person.

Additional Limits on Liability and Disputes

To the maximum extent permitted by law, any claim against Stay the Week, LLC will be limited to the greater of (a) the amount you paid to Stay the Week, LLC in the twelve months before the event giving rise to the claim or (b) one hundred U.S. dollars ($100). You agree that any dispute, claim, or proceeding you bring against Stay the Week, LLC must be brought only in your individual capacity and not as part of any class, collective, consolidated, or representative action.

Changes

We may update these Terms from time to time. Continued use of the service after updates means you accept the revised Terms.
